1013380 BC Ltd. (InCharge Life) provides the InCharge Life service (“we”, “us”): management software for gyms and fitness clubs. The InCharge Life app is published on the App Store and Google Play by 1904928 Alberta Inc. (InCharge Pay), which also provides payment processing.

This policy explains what information the app uses, why, and the choices you have. It covers the app only. Our Website Privacy Notice covers this website.

When you use the app, you are a member of a club that uses In Charge Life (“your club”). In most cases your club controls your member information and we process it on your club’s behalf. Your club may also have its own privacy policy.

The short version

  • Your gym or fitness club uses our software. The app shows you your membership, bookings, payments and check-ins, and lets your club send you notifications.
  • If you choose to connect Apple Health or Health Connect, the app reads your workouts and daily activity and sends them to your club, so they count towards challenges, goals and reward points.
  • The app only reads health data. It never writes to Apple Health or Health Connect.
  • We never use health data for advertising, we never sell it, and we never share it with anyone other than your club, except the providers that host our platform for us.
  • You can disconnect at any time in the app under Profile > Activity Sync.
  • You can delete your account at any time in the app under Profile > Delete my account.

Information the app uses

From your club account

  • Your name, email address, phone number and profile photo
  • Your membership, agreements, bookings, class and session history, and check-ins
  • Your invoices, payments and payment status (never full card numbers)
  • Reward points, challenges, goals and any other app features your club offers

When you sign in

  • Your username and password, and a sign-in token stored on your phone so you stay signed in

To send you notifications

  • A notification token for your phone, provided by Google Firebase Cloud Messaging (on iPhone, through Apple’s push notification service). We use it only to deliver notifications from the app and your club.

Health and fitness data (only if you connect)

  • Your workouts: the type of activity, start and end time, duration, distance and calories
  • Your daily steps, distance and active calories
  • On iPhone, your daily exercise minutes. On Android, your daily total calories.

Technical information

  • Your phone model, operating system, app version and IP address, which our servers record when the app connects, to keep the service working and secure

Card payments are handled by our payment processors. The app does not store full card numbers or card security codes.

Health and fitness data

The app can read activity from Apple Health (iPhone) or Health Connect (Android). This is optional. Nothing is read until you choose to connect under Profile > Activity Sync and give permission on your phone. You can choose which types of data to allow.

What we read

Only the types listed above: workouts, steps, distance, calories and (on iPhone) exercise minutes. When you first connect, the app reads up to the last 30 days. After that it checks for new activity when you open the app. Entries you typed into Apple Health or Health Connect by hand are left out.

What we do with it

  • We send it to your club’s In Charge Life account so your club can count it towards activity challenges, personal goals and reward points.
  • You can see your synced workouts and totals in the app. Your club’s staff can see them on your member record.

What we never do with it

  • We never write to Apple Health or Health Connect. The app only reads.
  • We never use health data for advertising or marketing, and never use it to build advertising profiles.
  • We never sell health data, and never give it to data brokers or information resellers.
  • We never share it with anyone other than your club, except the service providers that host and run our platform for us under contract, or where the law requires it.
  • We never use it to decide whether you are eligible for credit, insurance or employment.
  • We do not store it in iCloud.

The use of information received from Health Connect follows the Health Connect Permissions policy, including the Limited Use requirements. Data from Apple HealthKit is used only as described in this policy and in line with Apple’s App Store Review Guidelines.

Stopping and removing it

  • Disconnect at any time in the app under Profile > Activity Sync. The app stops reading straight away. On Android, disconnecting also removes the app’s Health Connect access.
  • On iPhone you can also turn off access in the Health app: tap your profile picture, then Apps, then InchargeLife. On Android, open Health Connect > App permissions > InchargeLife.
  • Activity that has already been sent stays on your member record so your challenges and points stay correct. To have it deleted, see Deleting your account and data.

How we use your information

  • To run the app and show you your membership, bookings, payments and activity
  • To let your club manage your membership and run its challenges, goals, rewards and offers
  • To send you notifications from the app and your club
  • To process payments through our payment processors
  • To give support and answer your questions
  • To keep the service secure and prevent fraud and misuse
  • To meet our legal obligations

We do not sell personal information. We do not show advertising in the app. We may use information that has been combined and made anonymous, so it no longer identifies anyone, to improve our software.

Who we share it with

  • Your club, which uses this information to provide your membership and run its programs.
  • Service providers who help us run the service, such as hosting, notification delivery (Google Firebase) and payment processing. They may use it only to provide their service to us and must protect it.
  • Authorities, where the law requires it or to protect our legal rights.
  • A buyer or successor, if our business is merged, sold or restructured. The information stays protected under this policy.

Where it is stored and for how long

Your information may be stored or processed outside Canada, including in the United States, where privacy laws may differ. We use contractual and security safeguards to protect it.

We keep your information while your club uses In Charge Life and you have an account with your club, and after that only as long as needed for legal, accounting and dispute reasons. When it is no longer needed, it is securely deleted or made anonymous.

Your choices and rights

  • Access and correction: you can ask to see the personal information held about you and ask for mistakes to be corrected.
  • Notifications: you can turn notifications off in your phone’s settings.
  • Health data: you can disconnect at any time (see above).
  • Delete your account: you can delete your account and its data at any time (see below).

Because your club controls your member information, we may pass your request to your club, or ask you to contact your club directly.

Deleting your account and data

You can delete your In Charge Life app account, and the data that goes with it, at any time.

In the app

Go to Profile > Delete my account and confirm. This works the same on iPhone and Android.

Without the app

Email support@inchargetechnologies.com from the email address on your account, with the subject “Delete my account”, and tell us the name of your club. We will confirm the request with you before anything is deleted.

What is deleted

  • Your app login, sign-in tokens and notification tokens
  • All health and fitness data synced from Apple Health or Health Connect
  • Your personal details on your club’s member record, which are removed or made anonymous, except the records described below

Deletion is completed within 30 days of your request.

What may be kept

Your club may need to keep some records, such as your membership agreement, invoices and payment history, for as long as tax and accounting laws require (generally up to six years). These records are kept securely and are not used for anything else.

Deleting your app account does not cancel your club membership or any payments you have agreed to. To cancel your membership, contact your club.

Deleting only your health and fitness data

To keep your account but remove your synced activity, disconnect under Profile > Activity Sync, then email us or ask your club to delete your synced activity.

Security

We use reasonable administrative, technical and physical safeguards to protect personal information, including encrypted connections between the app and our servers. No system can be completely secure, so please keep your password private.

Children

The app is for members of gyms and fitness clubs and is not directed at children under 13. Where a club has junior members, the club is responsible for getting a parent’s or guardian’s consent.

Changes to this policy

We may update this policy. We will post the new version on this page with a new effective date, and tell you in the app if the changes are significant.
